On January 18th, Wu‘s attorney and representative drove to Jieyang and Huilai of Guangdong Province. In the Huilai county court, they inquired about the status of the Litigation Proceedings that had been filed on December 20, 2012. However, they received the answer, "It is a simple case, but the matter is very complex; so you will need to wait a few more days."

Legal Steps Wu Has Taken

On January 18th, Wu's attorney and representative drove to Jieyang city and Huilai country  in Guangdong Province. In the Huilai county court, they inquired about the staus of the Litigation Proceedings that had been filed on December 20, 2012. However, they received the answer, "It is a simple case, but the matter is very complex; so you will need to wait a few more days."

 

According to the nature of China's judicial system, the judge cannot make independent decisions; even the Huilai District Court superiors must obey orders they receive from a higher authority. Although Wu followed all the proper steps in applying for a passport in early 2010, as well as in the legal rights process he started in the summer of 2012, yet the staff of the judicial and administrative systems have consistently given no response, thus being flagrant violation of the Chinese law. Although they are trying to block Wu's judicial application, whether Wu makes any progress in this case at any time soon, will be seen even though he acted completely in accordance with Chinese law.
 

 

1月18日,吴的代理律师和中国代表驱车前往广东揭阳和惠来县。在惠来法院,他们询问有关12月20日诉讼问题是否已经立案。 他们得到的回答是:‘案件很简单,事情很复杂,需要再等几日。’  中国司法系统的特点是法官不能独立。目前惠来地方法院还需要请示上级相关部门。虽然吴从2010申请护照开始,以及2012年的法律维权过程都是按照中国法律规定的程序来进行,但是司法系统,行政系统都不是按照法律规定来执行,他们总是迟迟不予回复,行政不作为,他们是公然践踏法律,试图堵住吴的司法救济之路。护照问题是否可以进入法律诉讼程序? 很快就会知晓。
